Understanding the differences between ways to challenge judgments is essential for every litigant in Kuwait. Through the Civil and Commercial Procedure Law (Decree-Law No. 38 of 1980), Kuwaiti law establishes a tiered system that gives litigants the right to challenge judgments to ensure justice through two main stages: appeal and cassation.

Appeal: Reviewing the Facts and Merits

An appeal is an ordinary means of challenging a judgment. At this stage, the Court of Appeal reconsiders the dispute afresh: it examines the facts, hears arguments, and reviews the evidence, with full authority to amend or overturn the first-instance judgment.

You may submit new evidence or raise arguments that were not presented before the court of first instance. The purpose of an appeal is to reach a more accurate and just judgment based on the same facts of the case.

Cassation: Reviewing the Application of the Law

Cassation, by contrast, is an extraordinary means of challenging a judgment. At this stage, the court does not concern itself with facts or witnesses. The Court of Cassation exercises legal oversight: it checks only whether the court that issued the appellate judgment applied the law correctly.

A cassation challenge is admissible only where there is a fundamental legal defect. Drafting a cassation challenge therefore requires a focus on an 'error in applying the law,' rather than retelling the events of the case.

When Should You Choose Each Route?

The choice depends on the nature of the judgment issued against you. If it is a first-instance judgment, an appeal is your first route. If it is an appellate judgment, cassation may be your next route if there is a clear legal error.

Frequently asked questions

Can I seek cassation directly without first appealing?

Generally, ordinary means of challenging judgments (appeal) must be exhausted before seeking cassation, in accordance with the legal rules governing litigation in Kuwait.

Does cassation stay enforcement of the judgment?

A cassation challenge does not automatically stay enforcement. In certain cases, it may be necessary to request specific measures to stay enforcement.
