The Kuwait Direct Investment Promotion Authority (KDIPA) publishes its investment licensing procedures on its official website. This article walks through what that page actually says — no more, no less — so an investor can see the shape of the process before engaging advisors.
The four stages
KDIPA describes its licensing as a four-step process. It begins with an investment proposal, moves to a business plan, and proceeds to the formal application stage, for which the Authority provides downloadable templates: Application Forms A, B and C, a power of attorney template and a board resolution template.
The templates themselves carry dates: the power of attorney and board resolution templates are dated November 2024, while the Application A/B/C PDFs are dated September 2021. Always download the current versions from KDIPA's site rather than relying on copies.
Stated timelines — and their limits
KDIPA's procedures page states that feedback on the application request form is given within three business days, and that a decision of the Director General follows within thirty working days. These are service statements published on a web page; they are not provisions of Law No. 116 of 2013 and they are not guaranteed timelines. Complex files, incomplete documents or sectoral approvals can extend the process.
The legal instruments behind the process
KDIPA's law-and-decisions page lists the framework instruments: Law No. 116 of 2013, its Executive Regulations, and separate decisions including No. 388 of 2024 (incentives), No. 182 of 2022 (fees), No. 180 of 2020 (tax-exemption mechanism), No. 394 of 2019 (branches), No. 393 of 2019 (representative offices), No. 329 of 2019 (application evaluation), No. 246 of 2017 (listing of consulting firms), and Cabinet Decision No. 75 of 2015 (the negative list).
Each of these is a separate legal instrument. None has yet been incorporated into this site's law library, and each must be read and signed off individually before its detailed provisions can be quoted. We flag this rather than paraphrase texts we have not verified.
Preparing a credible file
Regardless of the formal stages, the quality of the file matters: a coherent business plan, consistent corporate documents, properly legalized powers of attorney, and a clear statement of the intended activity matched to the correct classification. Files that arrive internally consistent move through any authority more smoothly.
Professional assistance
Fahad Al-Haddad Law Firm & Legal Consultants prepares and reviews KDIPA application files, aligns corporate documents with the Authority's templates, and follows up submissions through the channels the law provides. Preparation quality is the part of the timeline an investor can actually control.
