Public procurement is one of the most practical entry points into the Kuwaiti market for a foreign company. The gatekeeper is the Central Agency for Public Tenders (CAPT), which publishes its foreign bidder registration requirements in English — and which issued a circular in October 2025 that changed the local-agent question in tender documents.
Registering as a foreign bidder
CAPT publishes a dedicated English-language document setting out its foreign registration requirements. We have downloaded and hashed the file (SHA-256 recorded in our source registry) so that what we refer to is a specific, identifiable document. The detailed document checklist inside it has not yet been transcribed and signed off, so we point to the official file rather than paraphrase it.
Circular No. 16 of 2025: the local-agent change
On 21 October 2025, CAPT issued Circular No. 16 of 2025, effective the same day. Its operative text instructs all public entities, when preparing tender documents and their equivalents, not to include any condition obliging a foreign bidder to appoint a local agent or partner.
The scope matters: the circular covers public tenders, practices and direct contracting. It does not amend Article 23 of the Commercial Law, which continues to govern engagement in trade in Kuwait generally. A foreign company may therefore face no local-agent condition inside a tender, while still needing a lawful structure for its wider commercial presence.
What has not changed
Registration, qualification and documentation requirements still apply, and each tender's own terms govern the bid. The Public Tenders Law itself is not yet part of this site's law library, so we do not quote its articles; the framework described here rests on CAPT's published registration document and the text of Circular 16/2025.
Practical preparation
Foreign bidders should prepare corporate documents early: incorporation certificates, powers of attorney, financial statements and legalizations tend to drive the real timeline. Tenders also carry deadlines that do not wait for slow paperwork, so the registration file should be ready before an opportunity appears, not after.

Frequently asked questions
Do foreign bidders need a local agent for Kuwait public tenders?
CAPT Circular No. 16 of 2025 (21 October 2025) directs public entities not to include conditions requiring a foreign bidder to appoint a local agent or partner in tender documents. The circular covers public procurement; it does not change the Commercial Law's general rules for trading in Kuwait.
Where are the foreign bidder registration requirements published?
CAPT publishes them as an English PDF on its official file server. We keep a hashed copy reference in our source registry; the detailed checklist awaits transcription and legal sign-off.
Is the Kuwait Public Tenders Law in this site's law library?
Not yet. The tender framework described here rests on CAPT's published registration document and Circular 16/2025, not on the statute's text.
