The statement of claim is the backbone of a court dispute. Any error in its drafting or particulars can cost you considerable time and effort and, in the worst case, may lead to dismissal of the claim.
Incorrect Party Details
One of the most common mistakes is recording the opposing party’s details, such as their name or address, inaccurately. Make sure these details match official records.
Any material discrepancy in the defendant’s details may invalidate service of process, resulting in adjournment of the case and wasted time.
Unclear Presentation of the Facts
The facts should be set out in a clear, logical chronological sequence. Avoiding repetition and unnecessary wording helps the judge understand the dispute quickly.
Focus on the material facts that gave rise to the right or harm, and avoid peripheral details that do not affect the substance of the dispute.
Deficiencies in the Final Requests for Relief
The final requests for relief must be specific and unambiguous. Vague or general requests may be rejected by the court.
Make sure all your requests for relief are legally connected to the facts and evidence set out earlier in the statement of claim.
Omitting the Signature or Supporting Documents
A statement of claim that is not signed by the lawyer or the party concerned has no legal value. Failing to attach documents supporting the claim also weakens your position.
Make sure copies of all documents relied upon in your claim are attached when filing the statement of claim with the court registry.
Failing to Review the Legal Provisions
Relying on laws that are no longer in force or on incorrect interpretations of the law is a serious mistake. Always check the latest legislative amendments.
Relying on specialists or obtaining legal advice before filing the statement of claim ensures that it is properly drafted and consistent with the applicable legal framework.
