Article 336 of Jaafari Personal Status Law

English translation

The general conditions of a waqf are four: First condition: Possession, which is achieved by the beneficiary, his agent or guardian, or the beneficiary entity receiving the endowed property from the founder. It is an essential element without which the waqf does not come into existence. Second condition: Perpetuity, meaning that it is not limited to a period, whether short or long. Third condition: Immediate effect, whereby the waqf is created with immediate effect, not conditional upon anything; if he makes it subject to a condition, it is invalid. Fourth condition: The founder's exclusion of himself from the waqf, and that the waqf shall not benefit the founder. If he endows it solely for himself, the waqf is invalid.
