If paternal uncles and paternal aunts coexist and differ in their line of kinship, some being related through both parents, some through the father, and some through the mother through the mother, the relative through the father shall not inherit from him. If the relative through both parents is absent, the relative through the father shall take his place. إذا اجتمع الأعمام والعمات وتفرقوا في جهة النسب بأن كان بعضهم للأبوين وبعضهم
للأب وبعضهم للأم للأم لم يرثه المتقرب بالأب، ولو فقد المتقرب بالأبوين قام المتقرب
بالأب مقامه، والمتقرب بالأم إن كان واحدا كان له السدس، وإن كان متعددا كان
لهم الثلث يقسم بينهم بالتفاضل للذكر مثل حظ الأنثيين، وأما الزائد على السدس
أو الثلث فيكون للمتقرب بالأبوين واحدا كان أو أكثر يقسم بينهم للذكر مثل حظ
