Marriage is a contract constituted by verbal offer and acceptance expressing will and intention. Mere mutual consent between the contracting parties is therefore insufficient without verbal offer and acceptance indicating that consent. A mute person is excepted from this.

الزواج عقد يتقوم بالإيجاب والقبول اللفظيين الكاشفين عن الإرادة والقصد، فلا
يكفي التراضي بمجرده بين المتعاقدين دون ما يدل على هذا التراضي من إيجاب
