Article 165 of Personal Status Law

a- If a valid marriage is dissolved after consummation, the wife shall be entitled—in addition to maintenance for her waiting period—to a consolatory payment assessed at no more than one year’s maintenance, according to the husband’s circumstances, payable to her in monthly instalments following the expiry of her waiting period, unless the parties agree otherwise as to the amount or payment. b- The following are excepted from the preceding paragraph: 1- Judicial divorce for failure to provide maintenance because of the husband’s insolvency. 2- Separation for harm where the cause is attributable to the wife. - Divorce with the wife’s consent. 4- Annulment of marriage at the wife’s request. e- Death of either spouse Third Book Birth and Its Effects First Part Establishment of Parentage First Chapter General Provisions
