Article 5 of Kuwaiti Penal Code

Anyone who requests for himself or another, accepts or receives, even through an intermediary, from a foreign state or anyone working in its interest, money, any other benefit or a promise thereof, with the intention of committing an act detrimental to a national interest of the country, shall be punished by imprisonment for a fixed term of not less than five years and a fine not less than two thousand dinars and not exceeding what was given or promised. If the offender is a public official, entrusted with a public service or holds a public representative capacity, or if the offence is committed in wartime, the penalty shall be life imprisonment and a fine not less than two thousand dinars and not exceeding twice what was given or promised. Anyone who gives, offers or promises any of the aforementioned things with the intention of committing an act detrimental to a national interest of the country shall be punished in the manner specified in the preceding two paragraphs. Anyone who acts as an intermediary in committing any of the preceding offences shall likewise be punished in that manner. If the request, acceptance, offer, promise or intermediation is in writing, the offence shall be complete upon dispatch of the writing. The following shall be punished by death:
