Kuwait Court of Cassation principle number 10
State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Subject-matter jurisdiction: attributed to the court, not its chambers. Assignment by the court’s general assembly of adjudication of particular actions to the court’s various chambers is not a matter of subject-matter jurisdiction but merely an administrative distribution of work among those chambers. Exception: cases in which the law, by a special provision, singles out one chamber of the court for jurisdiction to hear particular matters, without that preventing its jurisdiction to hear other matters falling within its subject-matter jurisdiction of the court, unless the law provides otherwise. Example: personal status chambers hearing other matters unrelated to personal status.
Arabic original
Original Arabic judgment citations
