Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1122

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Appointment of a curator over the property of a person under interdiction does not preclude appointment of a guardian over his person. The reason therefor: the general rule is that guardianship over the person belongs to the father, then to the agnatic grandfather. In their absence, it belongs to the agnate in his own right according to the order of inheritance. The condition therefor. And the trial court's authority to select and appoint. Its criterion.
