Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1221

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Rules of inheritance by agnatic succession. Not applied in the Ja'fari school. Its restriction of inheritance to fixed-share heirs and relatives, without distinction between female and male kinship. The ranks of heirs in this school. Males and females. The earlier rank, even if female, excludes the subsequent rank, even if male. The effect of this: the entire estate belongs to the daughter or daughters, not to the deceased’s brother. Allowing the deceased woman’s siblings to inherit alongside her husband and daughter. An error in the application of the law.
