English translation of the principle

Judgments rendered in certain personal status matters, such as custody, taking a child into one's care, and giving effect to a child's choice to live with either parent or another person. Their res judicata effect is temporary. The reason for this. This effect remains in place until the grounds and circumstances of the judgment change. The basis for this. The rule of continuity in Islamic jurisprudence: a ruling remains established as it was until something arises requiring its alteration or removal. - 570 - Personal Status - Whether circumstances have changed after the judgment was rendered or have remained unchanged. A question of fact independently determined by the court of merits. Its condition. An example of sufficient reasoning for a judgment giving effect to a daughter's choice to live with her mother.
