A wife’s maintenance. Its basis. The marriage contract by which she is reserved for the husband’s right; her maintenance is therefore payable from his property even if she is in her father’s home, prepared to obey him. Her refusal to do so without justification. Its effect. The husband may obtain a final judgment requiring her to enter into obedience to him, and her maintenance is forfeited after her refusal to execute that judgment following service upon her is established, thereby rendering her recalcitrant.
