Kuwait Court of Cassation principle number 524

Separation on grounds of harm occurs when either spouse is harmed by remaining married, whether for a material cause from which injury by the other spouse through words or deeds can be inferred, or for other causes of discord between them, such as aversion or intense hatred, even if injury is not established where the wife is the party seeking separation, provided that in both cases continued marital life between the spouses is impossible. An example concerning establishment of harm on the wife’s part based on the report of the husband’s arbitrator.
