Separation on grounds of harm. Its meaning: either spouse being harmed by remaining in the marriage, whether for a material cause, in word or deed, or for another cause of discord, such as aversion and intense hatred, even if injury by the other spouse is not established. Its condition. The impossibility of continued marital life between the spouses. The basis therefor. Articles 126, 127, 130, 131 of Law 51/1984 concerning Personal Status.

التفريق للضرر. ماهيته تضرر أحد الزوجين من البقاء في الزوجية سواء بسبب مادي قولاً أو فعلاً أو بسبب آخر من أسباب الشقاق كالنفور والبغض الشديد ولو لم يثبت الأذى من الزوج الآخر. شرطه. عدم استطاعة دوام العشرة بين الزوجين. أساس ذلك. المواد ١٢٦، ١٢٧، ١٣٠، ١٣١ من القانون ٥١/١٩٨٤ في شأن الأحوال الشخصية.Original Arabic judgment citations
