The Constitution guarantees means of artistic expression of ideas in accordance with the conditions and arrangements prescribed by law. Artistic expert opinion must be sought when the court reviews the legality of administrative decisions banning artistic works or refusing to authorize them. The reason: ensuring an impartial opinion concerning what is sought to be published or authorized. The challenged judgment’s departure from this view. Renders it defective and requires its cassation.

الدستور كفل وسائل التعبير الفني عن الأفكار وفقاً للشروط والأوضاع المقررة قانونا. يجب الاستعانة برأي الخبرة الفنية عند مراقبة المحكمة لمدى مشروعية القرارات الإدارية بحظر الأعمال الفنية أو رفض التصريح بها. علة ذلك: توافر الرأي المحايد فيما يبتغى نشره أو التصريح به. مخالفة الحكم المطعون فيه هذا النظر. يعيبه ويوجب تمييزه.Original Arabic judgment citations
