The provisions of laws and regulatory decisions having equivalent status apply only to facts and legal positions arising during the period from their effective date until their repeal. They do not apply retroactively to prior facts unless retroactive effect is established by an express provision in the law or decision. Departure from this provision is impermissible where it is clear and plain in meaning. - An employee must be medically fit throughout his service to perform the duties of his position. Issuance of a decision by the medical authority determining his medical unfitness. Its effect: termination of his service as of the date on which the General Medical Council determines his medical unfitness. The employee’s remaining in service after that date.
