State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
An expert's opinion is no more than one element of evidence. Assessment thereof. For the court of merits. It may adopt or reject the expert's opinion so long as its inference is reasonable. - The challenged judgment correctly concluding that the appellant is not entitled to the financial benefits he claims and that the element of fault necessary to establish the administrative authority's liability for the material and moral damage alleged by the appellant is absent. The judgment's disregard of the expert's factual recording in his report of what the appellant claims in this regard. No defect.
