State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A plea of lack of jurisdiction as to judicial authority or subject matter. A matter of public order. The implication thereof. It is deemed to be before the court, which may rule on it of its own motion. - The appellant’s request to compel the administrative authority to re-enter him in the births register and grant him an extract of his entry after it decided to strike him off. This is a challenge to the negative decision issued by the administrative authority refusing re-entry and delivery of the certificate, over which the Administrative Circuit of the Court of First Instance has jurisdiction. The judgment’s departure from this and its implicit ruling that the Civil Circuit has jurisdiction. An error in the application of the law requiring cassation of the judgment.
