Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1367

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Acts of sovereignty. Their nature. Courts may not examine them. Determining what constitutes acts of sovereignty and falls outside judicial review is within the authority of the courts. The impossibility of members of the judiciary returning to work throughout the invasion period and their deprivation of their salaries constitute war damage, which falls within acts of sovereignty. Effect thereof. The Ministry of Justice is not liable for any damage arising therefrom. The Kuwaiti Government's payment of grants and wages to its nationals does not alter this. Reason therefor.
