Kuwait Court of Cassation principle number 1372

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The legislature's not providing a definition or specification of acts of sovereignty that courts are prohibited from hearing. Its import: leaving their determination to the judiciary, contenting itself with declaring the principle of their existence. The effect of this: courts have jurisdiction to determine the legal characterization of an act issued by the government and whether or not it constitutes an act of sovereignty. The court of merits' characterization of this matter is subject to review by the Court of Cassation.
