Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1379

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Interest is a necessary condition for the admissibility of an action. The existence of a direct personal interest of its claimant suffices in annulment actions. The reason: the proceedings therein are objective and are primarily directed at challenging the administrative decision itself. The existence of an interest therein does not require that the decision sought to be annulled affect a vested right belonging exclusively and individually to the claimant. What suffices for its existence. - The court of merits may investigate the conditions for admissibility of the action, verify that its requirements are satisfied, and ascertain the interest therein, without review.
