Kuwait Court of Cassation principle number 1400

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The time limit for bringing an action to annul an administrative decision. Sixty days. Interruption of this time limit by an administrative grievance to the authority issuing the decision or its superior authority. The time limit for the grievance. Before expiry of this time limit. A complaint submitted to an authority other than this authority, such as the State Commissioner or the Legal Affairs Department of the entity to which the complainant belongs. Is not considered an administrative grievance. What determines commencement of the time limit is its actual receipt by the competent authority. No receipt or paper issued by an authority other than the competent authority shall be recognized regarding the date of receipt of the grievance. - The passage of sixty days from submission of the grievance without answering the complainant constitutes a decision rejecting it. The complainant must bring the annulment action within sixty days from that date. Bringing the action after the prescribed time limit renders it procedurally inadmissible.
