Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1410

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The requirement that the defendant or respondent have standing in actions for annulment of administrative decisions. Its relation to public policy. Its effect. The court may examine it and rule upon it of its own motion when applying the law to the administrative dispute as to both form and substance and at any stage of the proceedings. - The appellate court may rule that the action is inadmissible whenever it has established grounds for inadmissibility, even if the judgment appealed against overlooked them. The reason therefor. A judgment against an administrative entity imposing something that cannot readily be enforced or that its budget cannot bear merely because it was joined as a party contravenes public policy, even if it did not plead lack of standing. - The defendant’s standing is one of the conditions of an action. Joinder in an annulment action. Against whom it is directed. An example of a ruling that an action is inadmissible for lack of standing of the defendant.
