Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1437

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An interest is a necessary condition for the admissibility of an action. The existence of a direct personal interest of the person bringing an annulment action is sufficient. The reason therefor: the proceedings are objective in nature and are directed primarily against the administrative decision itself. The existence of an interest therein does not require that the decision sought to be annulled affect an established right belonging exclusively and individually to the person bringing the action. What suffices for its existence. - Challenging general regulatory administrative decisions. Permissible. The methods and conditions therefor. Example.
