A judge is disqualified from hearing an action, even if none of the litigants seeks his recusal, if he is related by blood or marriage to any of them. The rationale: the existence of a close relationship between them requiring that he be prevented from hearing - 415 - Administrative the action, to safeguard the standing of the judiciary and the supremacy of its word, maintain the appearance of impartiality and protect judicial judgments from suspicion attaching to them on account of the judge personally. - A judgment issued in the action despite the disqualification of the judge who issued it or participated in issuing it. Its effect: its nullity on grounds of public policy. - Kinship, including affinity by marriage. Its nature. Articles 16, 17 of the Civil Code. - Affinity by marriage links one spouse to the relatives of the other spouse, although it does not link the relatives of each spouse to one another. عدم صلاحية القاضي لنظر الدعوى ولو لم يرده أحد من الخصوم إذا كان بينه وبين أحدهم صلة قرابة أو مصاهرة. علة ذلك: وجود صلة وثيقة بينهما تستوجب منعه من نظر - ٤١٥ - الإداري الدعوى صوناً لمكانة القضاء وعلو كلمته واستيفاء لمظهر الحيدة وضناً بأحكام القضاء من أن تعلق بها الاسترابة من جهة شخص القاضي. - صدور حكم في الدعوى رغم عدم صلاحية القاضي الذي أصدره أو اشترك في إصداره. أثره: بطلانه بطلاناً متعلق بالنظام العام. - القرابة. بما في ذلك قرابة المصاهرة. ماهيتها. م١٦، ١٧ مدني. - قرابة المصاهرة هي التي تربط بين أحد الزوجين وأقارب الزوج الآخر وإن كانت لا تربط بين أقارب كل منهما. مؤدى ذلك: أن أخ الزوجة يعتبر قريباً للزوج في ذات قرابته لأخته.مثال. - الدعوى الدستورية:-Original Arabic judgment citations
