Kuwait Court of Cassation principle number 1501

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An employee’s right to claim the financial entitlements prescribed for him against the Government becomes time-barred upon the expiry of one year from the date of his knowledge of those entitlements or five years from the date they became due, whichever period expires first. What is meant here by knowledge: the employee’s knowledge of his financial entitlement, its extent and its essential elements. Its absence. The one-year limitation period does not begin in its absence. Example of a plea that an employee’s right is time-barred.
