Kuwait Court of Cassation principle number 1630
State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The contract is the law of the contracting parties. As regards its parties, it is equivalent to law. It is a law specific to them, even though its origin is agreement, and its provisions are the reference for determining each party’s rights and obligations towards the other. - The trial court may ascertain the true nature of the relationship connecting the parties to the proceedings, discern the meaning of agreements, and understand the facts of the case without review thereof, provided that it bases its ruling on reasonable grounds. It may adopt the expert’s report in whole or in part or set it aside.
