Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 763

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of merits has the authority to ascertain and understand the facts of the case, assess the evidence, documents and grounds of defence, and adopt those it finds convincing. It suffices that it bases its judgment on sound reasons. It is not obliged to follow the litigants through the various aspects of their defence so long as it has stated the truth of which it is convinced and its evidence provides an implicit response disposing of all else. An example of a sound inference by the judgment and its reliance on valid reasons in explaining the appellant's relationship with the Public Authority for Applied Education and the benefits to which he is entitled by virtue of his work in a position within the general cadre. - 220 - Administrative
