Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1460

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The felony of permanent disability is any intentional physical act committed with intent to cause injury, whenever the disability results from it. - The judgment's recording in its text that the victim was pushed and fell to the ground, and its conclusion punishing the offender for the misdemeanour of causing perceptible injury, notwithstanding its finding that he deliberately pushed the victim, which suffices to establish the felony of disability as long as it is established that that disability resulted from the fall. Vitiates it by a violation of the law and contradiction in reasoning.
