Deducing the facts from their evidence and elements. A matter of fact. Condition thereof: that it be reasonable and that - 422 - Criminal Procedures and Trials the evidence have a basis in the case papers. Reason therefor. - The evidence relied upon by the judgment must lead to the results it derives from it without arbitrariness in inference and must not conflict with reason and logic. Criminal judgments are based on conclusiveness and certainty arising from the facts established by valid evidence, not on supposition and abstract considerations. The judgment's reliance on the appellant's confession, which has no basis in the case papers. It vitiates it. The other evidence it cited does not alter that. Reason therefor.
