Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1650

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Coercion invalidating a confession is anything that inflicts physical or moral harm on the person confessing, thereby affecting his will and inducing him to make it. - The accused's mere statement that his confession resulted from a compulsive psychological state arising from the conduct of arrest and search procedures and his questioning about the charge attributed to him. It does not constitute a plea of invalidity of the confession.
