State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The mere existence of physical possession of a narcotic substance. Does not establish criminal intent in narcotics offences. Evidence must establish the perpetrator's knowledge that what he holds is among the narcotic substances whose holding is prohibited by law. - The female appellant's plea that she did not know the nature of the narcotic substance requires the judgment to state what justifies its conviction that such knowledge existed. Its reliance merely on the seizure of the narcotic in her bag. Its implication: creating a presumption founded on assuming knowledge of the narcotic substance from the fact of possessing it, which cannot be accepted in law so long as criminal intent is an element of the offence. It must be actually established, not presumed. 25- The plea that the narcotic was planted:-
