الحكم في المعارضة بعدم قبولها. هو حكم شكلي. اقتصار الاستئناف عليه دون الحكم الغيابي المعارض فيه. علة ذلك. عدم اندماجها. خلافاًُ للحكم مرفقي المعارضة أو اعتبارها كأن لم تكن فإنهما يندمجان في الحكم الغيابي المعارض فيه وينصرف الاستئناف إليها.Original Arabic judgment citations
