Kuwait Court of Cassation principle number 1880

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Deeming the appeal nonexistent. The criterion for so ruling. - Deeming the opposition nonexistent. Its merger into the default judgment opposed. Its effect. The appeal extends to both judgments together. - 513 - Criminal Procedures and Trials - The appellant's opposition to the default judgment of conviction and the ruling deeming it nonexistent. His lodging an appeal against this judgment. Its extension to the opposed judgment that merged into it. The appellate court's undertaking to consider the appeal and stopping at consideration of the judgment on the opposition deeming it nonexistent, without considering the merits of the first-instance default judgment despite the aforementioned merger, renders its judgment defective and requires its cassation.
