Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1889

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The criterion for the impermissibility of the Public Prosecution's challenge by appeal or cassation to a judgment ordering the measure of institutional placement. Depends on the judgment ordering it having been issued in accordance with the provisions of the law, upon establishment of a state of addiction to narcotics use. The judgment must ascertain that state in the convicted person and establish evidence of it. Failure to do so: the judgment falls outside the scope of the prohibition and may be challenged by appeal or cassation.
