Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1959

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Splitting a single criminal action by determining the Public Prosecution's appeal on one occasion and the accused's appeal on another. Impermissible. Filing two appeals against the same judgment. They must be determined by a single judgment. The basis and reason therefor. - The Court of Appeal's determination of the Public Prosecution's appeal and the convicted person's appeal by two separate judgments, and its ruling upholding the judgment appealed against. Challenging the two judgments, whether as regards splitting the action or what the second judgment adjudicated, affords the Public Prosecution only a purely theoretical interest to which no regard is paid. Its effect: inadmissibility of the challenge. The reason therefor.
