Kuwait Court of Cassation principle number 24
State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The courts’ jurisdiction to hear actions brought before them derives from the authority vested in them. - The court of first instance may, when hearing the action, amend the charge by adding certain facts to it, changing its elements, or attributing new facts connected with those in respect of which the action was brought. - The court of first instance may join another accused or other accused persons to the action and adjudicate the charges brought against them. Reason therefor. Seeking and achieving justice in the interests of the community, while carrying out all procedures of service or investigative procedures required by the amendment; the court may grant the accused’s request to adjourn the hearing of the action to prepare his defence.
