Challenging the court for failing to take a measure that was not requested of it. Inadmissible. - The appellant’s making a request before the Court of Cassation for an inspection to be conducted. Inadmissible. The reason: a cassation appeal is not considered an extension of the proceedings. It is a special proceeding in which the court’s task is to adjudicate the validity of judgments in respect of the requests and grounds of defence presented to it.

النعي على المحكمة قعودها عن إجراء لم يطلب منها. غير مقبول. - إبداء الطاعن أمام محكمة التمييز طلب إجراء معاينة. غير مقبول. علة ذلك: عدم اعتبار الطعن بالتمييز امتداداً للخصومة. هو خصومة خاصة مهمة المحكمة فيها القضاء في صحة الأحكام فيما عرض عليها من طلبات وأوجه دفاع.Original Arabic judgment citations
