Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 538

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The confession relied upon. Must be voluntary. It is not considered so if made under the pressure of coercion or threats, whatever their degree, even if truthful. - 237 - Criminal Procedures and Trials - The court’s reliance on a confession requires it to examine the connection between it and the alleged coercion and to negate the occurrence of the latter through reasonable reasoning. Failure to do so invalidates the judgment. Basing the judgment on other evidence does not save it from this. Reason thereof.
