Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 569

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A confession must be voluntary. It is not considered so, even if truthful, if made under the influence of coercion or the threat thereof, whatever its degree. - Examining the connection between the confession and the alleged coercion and negating it through sound reasoning. A condition for the judgment's reliance upon it. - The investigating prosecutor's recording the presence of a medical bandage on the appellant's leg and that he was leaning on a crutch. The judgment's reliance on his confession and those of others, and its limiting its response to his plea that his confession in the Public Prosecution investigations was invalid as the product of coercion to stating that he and the others confessed in those investigations and that no evidence supports that plea, as it is subject to the court's assessment. Deficiency, defective inference and contradiction of what is established in the case papers invalidate it. The other evidence on which its ruling was based does not protect it from this; the reason therefor: the mutual support of the evidence.
