Kuwait Court of Cassation principle number 585

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A confession in criminal matters is an element of inference. Its assessment belongs to the trial court. It may accept the accused's confession at any stage of the investigation even if he retracts it, and may examine the extent of its connection to the alleged duress. The limit and implication thereof. - The authority of office, with the competence and powers it confers upon its holder. Does not constitute duress, so long as it does not extend to inflicting physical or psychological harm upon the accused. Mere fear of police officers does not constitute duress invalidating a confession, either in meaning or in law. An example concerning the accused's claim that the officer involved in the incident threatened to harm him if he denied the incident before the Public Prosecution. - 246 - Criminal Procedures and Trials
