Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 627

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Weighing witnesses’ statements. Within the authority of the trial court. Its reliance on a witness’s testimony, its import. It may rely on any evidence it finds convincing from whatever source it wishes. It may rely on the accused’s statements against himself and against other accused persons even if he subsequently retracts them. It is not obliged to follow the accused through the various aspects of his defense and respond separately to every doubt he raises.
