Kuwait Court of Cassation principle number 647
State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Merely observing the accused in an unsteady or abnormal condition, as stated in the officer's statements, which prompted him to search the accused and his car, a void procedure. The effect thereof. This nullity extends to the evidence derived from this procedure, consisting of that officer's statements, and his testimony is therefore disregarded. The judgment's reliance upon his statements in its ruling vitiates it for unsound inference and contravention of the law.
Arabic original
Original Arabic judgment citations
