An appeal by cassation is a personal right of the convicted person. He may exercise it or not exercise it. - Omission from the notice of appeal by cassation of the capacity of the person lodging it or the number of the power of attorney authorising him to do so, and absence from the papers of a power of attorney permitting this. Its effect: inadmissibility of the appeal as to form. The fact that the convicted person is a lawyer does not alter this. - The right of a lawyer acting as agent in a case to deputise another lawyer to plead or undertake litigation procedures on his behalf—without a special power of attorney—is an exception to the rule. - The rationale: facilitating lawyers' practice of the profession. Its condition: that the power of attorney contain no provision prohibiting this. It may not be extended or applied by analogy.
