Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1220

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The officer’s failure to record in his report the numbers of the banknotes he handed to the confidential informant to purchase the narcotics. Does not weaken the evidence derived from his statements or necessarily lead to their rejection where the court is satisfied with them. - The appellant’s oral admission to the officer that he possessed the narcotics with intent to traffic. Is considered part of the officer’s testimony. The court has complete discretion in assessing its veracity and evidential value. - The absence of previous activity by the appellant. Does not detract from the evidence of guilt of which the court was convinced and on which it relied in convicting him. - The presence of traces of the narcotic substance on the scale used to weigh the heroin packets. Not necessary.
