State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Offences that are indivisibly connected and committed for a single purpose. Their perpetrator is punished with the penalty prescribed for the most serious of them. Article 84 of the Penal Code. - The Unified Customs Law's prescription of a principal penalty for the offence of customs smuggling, acts deemed equivalent thereto, and attempts at either, after it had a supplementary penalty under the repealed Decree. Article 145 of Law 10/2003 promulgating the Unified Customs Law. The consequence: only the penalty for the most serious offence (importing narcotics with intent to use) must be imposed. The judgment's contravention of this and imposition of the customs fine for the offence of customs smuggling. A violation of the law that gives the Public Prosecution an interest in challenging it and requires partial cassation of the judgment and its correction by cancelling that fine. - The more favourable law in narcotic substance offences:-
