Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 162

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Obedience to a superior under Article 37 of the Penal Code does not extend to committing offences. - A subordinate must not obey his superior’s order to commit an act punishable by law. The contention in this regard is a manifestly unfounded defence. It warrants no response.
