State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The Constitutional Court’s ruling that the provision of paragraph 6 of Article 17 of Decree-Law 13 of 1980 concerning Customs is unconstitutional. Its effect: removal of the criminal character of the act of constructive customs smuggling, thereby fulfilling the meaning of the law more favourable to the accused and empowering the Court of Cassation to partially quash the judgment of its own motion in the appellant’s favour and acquit him of the customs smuggling charge.
